regarding NAV and Rune L. Hansen
I have not yet received any response or reaction to my
letter to NAV
Vindafjord dated 07.02. 2011 ( external
). I refer to
this my letter and to our prior
written communication ( external
).
You - ie NAV Vindafjord writes in letter
of decision
dated 20.12. 2010 ( external
) the following:
"Rune Hansen has a disability-benefit which makes up about
28 800,
- gross each month. From this it shall be withdrawn contribution
of 8410, -
and taxes of approx. 5600, -. In total, Rune Hansen then is being paid
approx.
14 700, - each month. Of fixed expenses, Rune Hansen have
house-rent around
1500, -, electricity of approx. 1000, -, and in
addition he shall have 5197, -
to his own life survival.
This make up to approx. 7700, - in current
expenses each month.
With a monthly payment of about 14 700, -, and
7700, - in current expenses, Rune shall then have 7000, -
again each month. /
Rune Hansen writes in the complaint that although that
his income has
increased because of repaid contributions debt, this is not enough. Nav
Vindafjord is working with minimum-rates, and consider the
circumstances regarding whether the individual has enough for the most
necessary, current expenses.
If 14 700 - is not enough monthly for Rune
Hansen, Nav Vindafjord have taken the consideration from
socialhelp-rates, where the conclusion is that Rune Hansen
have sufficient to make the costs social-services are
considering as
necessary. In addition to this, Rune Hansen also some money left over
each month. / In pursuant to The Social Services Act,
shall anyone who do not have opportunity to
cover it self, got covered life-survival, house-rent and
electricity."
These your data and the letters other
informations does not
match what is stated in the facts you have been and are in possession
of. For to keep order, I refer again to my overview and documentation
of
the facts stated in my letter dated
22.12. 2011 to NAV Vindafjord
( external
). From this I will here now refer the following:
"As stated in the overview of my fixed expenses per. month
(for year 2010) - without several important items (either house
maintenance,
car maintenance and use, savings, debt, unexpected expenses, etc.) and
based on a very limited budget and life on emergency-flares and
without possibility for further regular progress and which
neither not take regardings to the particularly difficult
conditions I and my family have
been put in and neithet not the outplundering and the harassment that
has taken place, as
it has been in 2010 - gives a cost of kr. 16.386,- pr. month. /
Shall
one in this design include such items here in this writing given
of fixed monthly expenses on emergency-flares that
not are filled will total
my monthly expenses might be estimated around 25.000 kr. / I have no
income other than my Social Security (disability pension), as like
the conditions now are is much lower than this."
It appears from this that your documentation is not
correct. Also to mention here is that what I was getting paid by Social
Security for
January 2011 was kr. 13.700, - and also for February 2011. Not 14.700,
-
kr.
Is the reason for your lack of response the letter
dated
21.01. 2011 from the County Governor of Rogaland, Health and Social
Affairs ( external
), as you are familiar with?
The letter from the County with a decision - which is
final and can not be appealed, it says. And it is also says among
other, that the County "reaffirm the municipalitys decision dated
20.12.2010, case-nr. 10/616" and that "the County does not give you
pursuant to your complaint".
In order to once again point out the mis-relationship
between their calculation and mine I will refer to the following note I
did 18.02. 2011:
"From the Norwegian state through NAV arrived me
today for this month (February 2011) kr. 13.700, - in social security
payments. / And I have now in the day of today of those paid the
most important
of the regular monthly bills. It was like common during this time with
even ongoing economic harassment towards me from NAV's side
absolutely nothing left for the other bills or to groceries or
anything. / I
refer to my regularly updated Household budget
( external
)."
Above budget and otherwise facts, you are familiar
with. And the difference to the allegations you are operating with are
great.
Just as I have pointed out which statutory provisions
shall be and is current with respect. to the obligations of employees
in NAV and NAV Vindafjord have. And have violated in relation to
me.
This I have especially made in my letter to NAV
Vindafjord dated
03.01. 2011 ( external
). Which I still neither not have received any feedback or
response on.
I wrote yesterday following note regarding these matters,
which I reproduce here:
"
Murderings and terminations via NAV
Not di I get money for food and groceries and not neither
to the others who is needed to live and to survive.
I get so small that I only is given the choice of the
order
of the fatal clashes, or way to get killed.
I am given the following choices:
01: By to be without food and groceries.
02: By to be without firewood and electricity.
03: By to be without telephone- and
Internet-connection.
04: By to be without car,
transportation- and travel-opportunities.
05: By to be without home, via the
housing-expenses.
06: By not to pay the bills they unjustifiably give me.
This they know and are intentional. It is also
such they do killing and
terminations.
While they at the sam time cover over with false
documentation.
They have their key-persons and "useful idiots" to
perform
suchs.
But can I not get me a job that I make money from
then?
To avoid having to try to live with the social
security insurance?
I can not, for the following reasons:
Because all my time and labor are going to the work withe
the
case-complex.
And because I relate me in solidarity to others in the
same
or similar situation.
Also otherwise in solidarity with all those who are
unable to have paid work.
I must also therefore do the documentation on what
is happening, and also relate me to that.
Not least for to be able to stop the injustice,
murderings and
terminations.
I can neither down-prioritize this matter or respond with
careless to
it.
I document how it is being done.
Even how I myself is being tortured and terminated.
The person or they who says I have a choice such are
thinking wrong.
And even though if I tried to choose different so it would
not go much differently better.
If I choosed differently it would be much worse for
everyone,
everyone and everything.
I have no choice like that seen.
Other than to relate me good and right to the whole.
And I do of course.
Anything else would also have been to be killed even
faster.
Simple and fair enough like that seen.
Knowledge and insight into this who is ongoing
obligates every human being.
To to get stopped the criminal madness.
For my part, it is also not least my own children
I have to consider.
But it consider also in relation to other
humans and children.
And in relation to all and any.
Such of criminal madness neither must either
shall should be able
to continue.
"
As is also evident from this, it is serious
relations this all are about.
I have received a letter from the Norwegian Road
authorities that says that the licence plates for
my car would be taken off if I not get in orden with the European
Union control of the car within February 2011. But how
can I when I barely have money for petrol once, or to pay for such an
EU-control? Thus, I therefore also are being without car, which I
have used in the
past 30 years time. And how will NAV defend this?
Without the car, I could not even drive to or get me
to the
nearest grocery store to buy food and groceries. It is from home 13.1
kilometers
round trip to the near-grocery (Vikebygd store). And 38.9 km round
trip Skjold. And 99.6 km round trip Haugesund.
If I around the New Year time had not gotten borrow
money
from my mother to pay the telephone- and internet-bill, I would now
also
have been without both telephone- and Internet-connection. And how
will NAV defend this?
Nor is my request to NAV Vindafjord regarding Statens
Innkrevingssentral (the States Collection Agency) yet answered.
And how will NAV defend this?
And a whole lot more are not adequately or at all
answered.
The economic harassment from NAV's side have now been
ongoing very long time and in different ways damaging and
life-threatening. As evidental from all this that you have been
and are
updated and informed about. And herewith now even more.
I made you aware of among others the following current
statutory provision:
Human Rights Act, Annex 4, Article 11, paragraph 1:
"States Parties recognize the right of everyone to an
adequate standard of living for himself and his family, including
adequate food, clothing and housing, and to the continuous improvement
of living conditions. States Parties shall take the necessary measures
to ensure the realization of this right."
And in concordance with this, the Social Services
Act, § 1 (purpose of the Act determination) determined the
following:
"§ 1-1. Purpose. / The purpose of this Act is
a) To promote economic and social security, to improve
living conditions for disadvantaged, to contribute to greater equality
and gender equality and prevent social problems,
b) ensure that the individual has the opportunity to live
independently and to have an active and meaningful life in community
with others. "
Something similar is also stated in the Human Rights Act,
Annex 4, Article 9:
"The States Parties to the present Covenant recognize the
right of everyone to social security, including social insurance."
Furthermore, I would here further point on that not
only
the Penal Code prohibits the harassment and torture
employees in NAV
and NAV Vindafjord expose me to, but also the Human Rights Act,
Appendix 2, ECHR, Article 3:
"Prohibition of torture. No one shall be subjected to
torture or to inhuman or degrading treatment or punishment."
And the Human Rights Act, Annex 6, Article 7:
"No one shall be subjected to torture or to cruel, inhuman
or degrading treatment or punishment. In particular, no one shall be
subjected without his free consent to medical or scientific
experimentation."
And when now even the ongoing harassment from the
NAV's side more and more critical threaten home and
property with more and more
acute is and are the relation also a crime against the Human
Rights
Act, Appendix 2, ECHR, Protocol 1, Article 1:
"Protection of property. Every natural or legal
person is entitled to the peaceful enjoyment of his possessions. No one
shall be deprived of his possessions except in the public interest and
subject to the conditions provided for by law and by the general
principles of international law. / The preceding provisions shall
not, however, in any way impair the right of a State to enforce such
laws as it deems necessary to control the use of property in accordance
with the general interest or to secure the payment of taxes or other
contributions or penalties."
At the same time, I will for the sake of clarity here now
draw
attention also to the following fact also valid statutory
provisions:
Human Rights Act Annex 4, Article 5, Sections 1 and 2:
"1. Nothing in the present Covenant may be interpreted as
implying for any State, group or person any right to engage in any
activity or to perform any act aimed at the destruction of any of the
rights or freedoms recognized herein, or at their limitation to a
greater extent than is provided for in the present Covenant.
2. No restriction upon or derogation from any of the
fundamental human rights recognized or existing in any country in
virtue of law, conventions, regulations or customs shall be admitted on
the pretext that the present Covenant does not recognize such rights or
that it recognizes them to a lesser extent."
Human Rights Act, Annex 6, Article 2:
"1. Each State Party to the present Covenant undertakes to
respect and to ensure to all individuals within its territory and
subject to its jurisdiction the rights recognized in the present
Covenant, without distinction of any kind, such as race, colour, sex,
language, religion, political or other opinion, national or social
origin, property, birth or other status.
2. Where not already provided for by existing legislative
or other measures, each State Party to the present Covenant undertakes
to take the necessary steps, in accordance with its constitutional
processes and with the provisions of the present Covenant, to adopt
such legislative or other measures as may be necessary to give effect
to the rights recognized in the present Covenant.
3. Each State Party to the present Covenant undertakes:
a. to ensure that any person whose rights
or freedoms as herein recognized are violated shall have an effective
remedy, notwithstanding that the violation has been committed by
persons acting in an official capacity;
b. to ensure that any person claiming
such a remedy shall have his right thereto determined by competent
judicial, administrative or legislative authorities, or by any other
competent authority provided for by the legal system of the State, and
to develop the possibilities of judicial remedy;
c. to ensure that the competent authorities
shall enforce such remedies when granted."
Human Rights Act, Annex 6, Article 5:
"1. Nothing in the present Covenant may be interpreted as
implying for any State, group or person any right to engage in any
activity or perform any act aimed at the destruction of any of the
rights and freedoms recognized herein or at their limitation to a
greater extent than is provided for in the present Covenant.
2. There shall be no restriction upon or derogation from
any of the fundamental human rights recognized or existing in any State
Party to the present Covenant pursuant to law, conventions, regulations
or custom on the pretext that the present Covenant does not recognize
such rights or that it recognizes them to a lesser extent."
Human Rights Act, Annex 6, Article 12, Paragraph 3:
"3. The above-mentioned rights shall not be subject to any
restrictions except those which are provided by law, are necessary to
protect national security, public order (ordre public), public health
or morals or the rights and freedoms of others, and are consistent with
the other rights recognized in the present Covenant."
